Summary:
An Ontario Provincial Police constable was charged under s. 1(g)(i) of the Code of Offences in the Police Act Regulations with unlawfully or unnecessarily exercising authority during an arrest. The constable's superintendent found the constable guilty and ordered that he forfeit two days' pay. The Commissioner of the Ontario Provincial Police reviewed and confirmed the superintendent's decision. The constable appealed to the Ontario Police Commission under s. 58 of the Regulations.
The Ontario Police Commission dismissed the appeal from conviction. The Commission, however, increased the penalty to five days without pay, the maximum number of days allowed by the Regulations. The constable had no notice that the Commissioner on appeal would seek an increased penalty. The constable applied for judicial review of the Commission's decision.
The Ontario Divisional Court allowed the application, set aside the order of the Police Commission, and substituted an order dismissing the constable's appeal to the Commission.
