Persons who can sue and be sued - Individuals - Class or representative actions for damages - Alberta Rules of Court, Rule 42 - In an action for damages arising out of a motor vehicle accident the plaintiff sued in his own right and on behalf of several members of a law firm - The defendants applied to strike out the portions of the plaintiff's statement of claim which related to a representative action - The Alberta Supreme Court, Trial Division, allowed the application and struck out the plaintiff's representative action because the damages claimed were to be assessed personally for each person - The Trial Division stated that a representative or class action pursuant to Rule 42 required a claim for general damages for the class as a whole.
