HEALTH LAW

The term “Health Law” is being used to incorporate a vast number of disparate topics generally re-

lated to the various health professions: medicine, nursing, and dentistry, etc. Most often the nexus

between these professions and law comes about by way of malpractice/negligence litigation, but

this is not exclusively the case. For the most part, this is an area that is provincial in scope in that

the provinces grant the various professional groups, by way of delegated powers, the authority

to establish the criteria for membership in their professions and the rights of discipline and dis-

missal. They also establish professional standards and are normally the f‌irst to judge professional

sociaux (par ex. assurance-hospitalisation) relèvent en réalité de la sécurité sociale. Les règles
