Summary:

This case arose out of an application for a committal warrant and the extradition of Humberto Pagan Hernandez to Puerto Rico for trial on a charge of murder. The trial judge acting pursuant to provisions of the Extradition Act refused to issue a committal warrant. The Federal Court of Appeal dismissed an application to review and set aside the decision of the trial judge.

The Federal Court of Appeal reviewed the authorities with respect to the burden of proof required for the committal of the accused pursuant to the provisions of the Extradition Act - see paragraphs 4 to 10.

With respect to the sufficiency of the evidence to justify the issue of a committal warrant the Federal Court of Appeal approved the "probably guilty" test - see paragraph 17.
