Summary:

Hudson's Bay Company took default judgment against the defendant and applied to have post judgment interest fixed in accordance with s. 21 of the Northwest Territories Judicature Ordinance.

The Northwest Territories Supreme Court dismissed the application because s. 21 was inoperative.

Federal jurisdiction - Interest, post judgment interest - Constitution Act, 1867, s. 91(19) - S. 21 of the Northwest Territories Judicature Ordinance provided for post judgment interest at the "prime rate" - The Northwest Territories Supreme Court held that s. 21 was inoperative because it conflicted with ss. 12 and 13 of the federal Interest Act (see paragraph 25).
