Summary:

The Information Commissioner of Canada applied under s. 42(1)(a) of the Access to Information Act for disclosure of the record of a meeting of the Executive Committee of the Canadian Radio-Television and Telecommunications Commission (C.R.T.C.) respecting an application before the C.R.T.C. The Federal Court of Canada, Trial Division, dismissed the Information Commissioner's application for disclosure.

Freedom of information - Legislation - Application of - Consultations or deliberations by Canadian Radio-Television and Telecommunications Commission's Executive Committee - The Access to Information Act, s. 21(1)(b), provided that a government institution head could refuse to disclose any record containing deliberations between government officials - S. 21(2)(a) provided that s. 21(1)(b) did not apply to records containing reasons for decisions - The Federal Court of Canada, Trial Division, held that the final Reasons for Decision of the C.R.T.C. would have to be disclosed pursuant to s. 21(2)(a), but that a record of deliberations between Executive Committee members respecting an application before the C.R.T.C. could be kept confidential under s. 21(1)(b) - See paragraph 1.

Freedom of information - Bars - Consultations or deliberations by government officials - Canadian Radio-Television and Telecommunications Commission Executive Committee - The Access to Information Act, s. 21(1)(b) allowed a government institution head to refuse disclosure of any record containing deliberations between government officials - S. 49 permitted the court to order disclosure where, inter alia, the institution head was not authorized to refuse disclosure - The Federal Court of Canada, Trial Division, stated that if a record fell within s. 21(1)(b), the institution head had a discretion respecting disclosure - The court refused to review an exercise of this discretion by the Chairman of the C.R.T.C., where the record in question was one to which s. 21(1)(b) properly applied - See paragraphs 2 to 4.
