Summary:
Cartwright, C.J.C. [orally for the Court]: Mr. Turnbull, we do not find it necessary to call upon you.
The appeal has been fully argued and we have had an opportunity since the adjournment on Friday last to consider the authorities to which counsel referred.
We agree with the conclusion arrived at by the Appeal Division and we are in substantial agreement with the reasons of Limerick, J.A.
The appeal is dismissed with costs.
