Summary:

A father applied for access to his illegitimate eighteen month old daughter against her mother under s. 32 of the Provincial Court Act, R.S.A. 1980, c. D-37. The parties requested a consent custody order in favour of the mother. The Alberta Provincial Court allowed the father's application for access. The court stated that there was some question whether s. 32 of the Provincial Court Act conferred jurisdiction on the Provincial Court to issue custody orders. The court stated that the mother had custody of her daughter under the Domestic Relations Act, R.S.A. 1980, c. D-38, and since the father did not contest her custody, the court did not grant the custody order.
