Summary:

A wife commenced a divorce and matrimonial property action. Days later, she removed selected property from what she alleged was the matrimonial home with the assistance of her mother, brother and sister. The husband and his company sued the wife and her family members alleging torts of conspiracy, intentional interference with economic relations or conspiracy to do the same, breach of copyright, unjust enrichment, and the torts of conversion, detinue, trespass and damage by negligence and abuse of the legal process respecting their removal of the property. The family members sought summary judgment dismissing the action against them. A Master dismissed the application. The family members appealed.

The Alberta Court of Queen's Bench, in a decision reported at 365 A.R. 201, allowed the appeal and dismissed the action against the family members. The family members sought costs.

The Alberta Court of Queen's Bench awarded the family members costs totalling $11,796 (Column 5).

Judgments and orders - Summary judgments - Costs - A wife commenced a divorce and matrimonial property action - Days later, she removed selected property from what she alleged was the matrimonial home with the assistance of her mother, brother and sister - The husband and his company sued the wife and her family members alleging various torts for damages totalling approximately $13,000,000 - The family members sought summary judgment dismissing the action against them - A Master dismissed the application - The family members successfully appealed and the action was dismissed against them - The family members sought costs - The plaintiffs argued that the family members were aware that the amount claimed was inflated and should not be characterized as within any multiple of Column 5 (the column defined by the plaintiffs' claim) but, rather, Column 1 or some other column - The Alberta Court of Queen's Bench awarded the family members costs totalling $11,796 based on Column 5 - Given the relative simplicity of the proceedings to this point, the court held that it was not appropriate to impose any multiple of Column 5 - The court declined to defer payment of the costs under a conditional "Sanderson Order" on the basis that the action was still outstanding against the wife - The action against the family members was complete - See paragraphs 1 to 9, 27 to 47 and 65 to 71.

Costs - General principles - Discretion of court - The Alberta Court of Queen's Bench reviewed general principles as to costs and stated, inter alia, the "idea of costs - and why a Schedule was designed by the Court - was to ensure that there was a consistency of pattern in relation to how Courts would approach litigation generally, and, indeed, by that means to give a signal to litigants as to exactly what they could anticipate when dealing with litigation generally. It seems to me very important - as a matter of policy and as part of the background of an analysis relative to costs in a particular case - that the Court remember that the content and the language of the Rules that apply to them should be fairly scrupulously applied - and with a high degree of certainty and exactness that the cases have mentioned - in order to ensure that all litigants who come into the legal process are given a fair opportunity before embarking or while they are continuing with legal proceedings as to what exactly their predicament may be in relation to costs." - See paragraphs 20 and 21.

Costs - Party and party costs - Offers to settle - Grounds for denying double costs -Several defendants obtained summary judgment dismissing the plaintiffs' action against them - They sought double costs based on an offer to settle - The offer did not limit itself to being an offer to discontinue without costs this particular action only - It included "any and all matters, causes of action claims, demands and damages whatsoever, which the releasors [plaintiffs] may have had or now have..." -The Alberta Court of Queen's Bench declined to award double costs - The offer could not be beaten by the court because the release covered all, inter alia, claims the plaintiffs might have - The release was not such as could be reasonably expected to be accepted in its terms by the plaintiffs - See paragraphs 48 to 64.
