Summary:

The father applied to permanently and retroactively lower the amount of child support payable by him in accordance to the Child Support Guidelines. He also sought an order that the monthly disability benefit amount forwarded by the Canada Pension Plan to the mother for the children be deducted from his child support payments. The father also sought a direction that any overpayment by him as a result of the court's decision be credited to the children's post-secondary education and other s. 7 expenses of the children.

The Alberta Court of Queen's Bench ordered as follows: (1) the court was bound to apply the Guidelines amount corresponding to the father's income; (2) the Canada Pension Plan amount was not to be deducted from the father's child support payments; (3) the father did not have to contribute to s. 7 expenses.

Divorce - Corollary relief - Maintenance and awards - Awards - Effect of assistance by the state - The payor father was legally blind - As a result, a monthly Canada Pension Plan child benefit amount was forwarded to the mother for the children - The father's income was $37,000 annually - The income of the father's live-in girlfriend was unknown as their respective finances were "totally separated" - The father lived in Alberta - The mother lived in Toronto with the children - She earned $94,000 - The father sought an order for the deduction of the Canada Pension Plan amount from his Guideline child support payment - He also sought a direction that any overpayment by him as a result of the court's decision be credited to the children's post-secondary education and other s. 7 expenses of the children - The Alberta Court of Queen's Bench ordered as follows: (1) the court was bound to apply the Guideline amount; (2) the Canada Pension Plan amount could not be deducted from the father's child support payments; (3) however, the court had discretion respecting the s. 7 expenses - The court applied the hardship test based on the respective incomes of the parties and ruled that the father did not have to contribute to the s. 7 expenses - Finally, the court was not prepared to draw an adverse inference against the father because he did not supply his girlfriend's income - See paragraphs 1 to 37.
