Summary:

The plaintiff leased the former Brunterm container terminal in Saint John. The original lessor, Ports Canada, was succeeded by Saint John Port Authority. The plaintiff sought reimbursement from the Port Authority (the defendant) for real property taxes it paid from 1981 to 1995 for parcel "C" at the terminal. Particularly, the plaintiff asserted that under the lease terms, the defendant agreed to pay grants in lieu of taxes for parcel "C". The defendant argued that the provision to pay grants was ultra vires its scope under the Municipal Grants Act. Moreover, the defendant argued that the claim was statute barred.

The New Brunswick Court of Queen's Bench, Trial Division, in a decision reported at 237 N.B.R.(2d) 158; 612 A.P.R. 158, allowed the plaintiff's action. The provision to pay grants was not ultra vires the defendant's scope. Moreover, the claim was not statute barred. The court requested further briefs on the issues of damages, interest and costs and then issued further reasons to be read with the initial reasons. The Port Authority appealed. The plaintiff cross-appealed a 50% reduction in the interest on its award. The Province cross-appealed the trial judge's refusal to award it costs.

The New Brunswick Court of Appeal, Drapeau, J.A., dissenting in part, allowed the appeal and the cross-appeals.
