Summary:

An estranged wife applied for interim exclusive possession of the matrimonial home pending an application for various relief under the Family Law Reform Act. The intention was to remove the alcoholic husband and father of three from the family home, ostensibly because such would be in the best interests of the remaining infant child.

The Ontario Court (General Division), dismissed the application for lack of evidence to take such a serious step.
