Summary:

A couple were divorced. The husband applied to cancel or reduce spousal support of $6,000 per month he currently paid to the former wife retroactive to June 23, 2012 (the date the wife remarried). The wife opposed any change in the current order, whether retroactive or prospective. She claimed that the spousal support order was at least partially intended for compensatory purposes and that any change in the existing terms would deprive her of the compensation to which she was entitled.

The British Columbia Supreme Court, in a decision reported [2014] B.C.T.C. Uned. 1384, reduced the amount of support to $3,000 per month "effective June 1, 2014 and not retroactive beyond May 1, 2014". The husband appealed, seeking to have his support obligations terminated, and asked that such termination be made retroactive to June 23, 2012, or to May 17, 2013 (the date the appellant filed his application for variation). The wife accepted the order made by the trial judge but opposed any further change.

The British Columbia Court of Appeal dismissed the husband's appeal.
