Summary:
The plaintiff subcontractor brought equitable claims against the defendants arising from alleged fiduciary duties and the relationship between the parties. The trial judge dismissed the action against both defendants on the ground that it was statute-barred. The defendants appealed.
The Yukon Court of Appeal dismissed the appeal.

Actions - General - Breach of fiduciary duty - Defence Construction Ltd. let a construction contract - Defence subcontracted the work to its subsidiary Bot - Bot subcontracted work to Nutaaq, who subcontracted to Lameron - Upon completion, Nutaaq and Lameron claimed unpaid amounts - Bot offered Nutaaq $80,000, prompting Nutaaq to offer settlement of Lamerton's claim, which Lamerton refused - Nutaaq accepted Bot's offer and received payment - Nutaaq's claim under a labour and material payment bond was withdrawn by Nutaaq's grandparent company (IRC) - Lamerton sued Nutaaq's principal employee and IRC, making equitable claims based on alleged fiduciary duties and the relationship between the parties - The Yukon Court of Appeal held that the limitation periods for both claims was six years.
