Résumé:

This case arose out of an application by a mother for the custody of her three year old son. The mother and the father were separated. The separation was the result of an adulterous relationship between the mother and another man. At the time of the application the mother was caring for the boy in Montreal where she worked as a secretary. The court reviewed the father's ability to care for the child and also the father's unsatisfactory history in the past of caring for the child. The New Brunswick Court of Queen's Bench awarded custody to the mother with access to the father. The judgment of the Court of Queen's Bench is set out below immediately following the New Brunswick Court of Appeal judgment.

The Court of Appeal dismissed an appeal and affirmed the judgment of the Court of Queen's Bench.
