LEGAL THEORY

Legal theory asks the question: “What is law?” Although the answer to this question might at

f‌irst seem straightforward, it is a weighty issue that has engendered a torrent of written opin-

ion and theorizing. Some view law as a “system of rules,” others have seen law as f‌itting into

larger matrixes and have thus developed other schools of thought (e.g., utilitarianism, legal

positivism), while still others have theorized about law in other contexts (e.g., economic, socio-

logical, feminist, etc.). This lists three Canadian titles in the f‌ield, and two from the United

Kingdom. This is a topic in which nationality is essentially immaterial. Related topic: LEGAL

La recherche des concepts fondamentaux du droit, des liens entre les éléments du système

juridique, la critique de l’idéologie juridique et la recherche d’une cohérence axiologique ou

téléologique, sont autant de raisons de s’intéresser au vaste domaine de la théorie du droit.

Ce domaine comprend, selon les déf‌initions qu’on en donne, la philosophie du droit, l’épisté-

mologie du droit et la méthodologie fondamentale. Il touche à la RÉDACTION JURIDIQUE, à

l’INTERPRÉTATION DES LOIS et à la recherche en droit (autre que documentaire).
