Summary:

The Workers' Compensation Board of British Columbia (WCB) appealed the order of a chambers judge certifying the underlying proceeding as a class proceeding under the Class Proceedings Act (CPA), and making other ancillary orders. See [2014] B.C.T.C. Uned. 1443. The proceeding related to the WCB's policy respecting the payment of interest on retroactive compensation benefits under the Workers Compensation Act (WCA).

The British Columbia Court of Appeal allowed the appeal and dismissed the respondent's certification application on the ground that a class proceeding was not preferable to a stand-alone judicial review. The court also considered that: (i) the class included members who had not pursued internal appeal remedies and who had missed the limitation periods for doing so, thereby using the CPA to create substantive rights to litigate and ignoring the importance of finality in decision-making; and (ii) the common issues were defined such that the court and not the Board determined entitlement to compensation under the WCA. The court noted that the two latter issues were relevant to the preferable procedure consideration but, did not, by themselves, wholly dispose of the matter.
