Federal or provincial legislation - Appli­cation of legislation - A public servant was released when she became incapaci­tated from a job related injury - An appeal board, set up under s. 31 of the Public Service Employment Act, dismissed her appeal without deciding whether there was a violation of the Cana­dian Human Rights Act - The Federal Court of Canada, Trial Division, set aside the appeal board's decision - The court held that the appeal board was bound to apply the employment provisions of the Human Rights Act to determine whether the employee's rights were violated and to determine what efforts the employer made to accommodate her - The court remitted the case to the board to adjudicate on these matters.
