A public servant was released when she became incapacitated from a job related injury. She appealed. The Public Service Appeal Board dismissed her appeal. She then applied for judicial review.
The Federal Court of Canada, Trial Division, allowed the application, set aside the board's decision and remitted the case for reconsideration.

Federal or provincial legislation - Application of legislation - A public servant was released when she became incapacitated from a job related injury - An appeal board, set up under s. 31 of the Public Service Employment Act, dismissed her appeal without deciding whether there was a violation of the Canadian Human Rights Act - The Federal Court of Canada, Trial Division, set aside the appeal board's decision - The court held that the appeal board was bound to apply the employment provisions of the Human Rights Act to determine whether the employee's rights were violated and to determine what efforts the employer made to accommodate her - The court remitted the case to the board to adjudicate on these matters.
