Summary:

After a license renewal hearing a city refused to renew Mariano's license to operate billiard tables, lunch counter, amusement arcade and tobacco sales. Mariano applied for judicial review.

The Ontario Divisional Court dismissed the application.

The hearing - Nature or extent of hearing - Hearings by municipal councils - A municipal council was required to hold a license renewal hearing - The Ontario Divisional Court stated that the purpose of such a hearing was to provide a forum for persons adversely affected to assert their objections - The court stated that license renewal decisions are political in nature and not judicial notwithstanding the re­quirement of a hearing (see paragraph 34).
