Summary:
Martinoff sought an order requiring the Commissioner of the R.C.M.P. to issue him a Canada-wide licence to sell firearms.
The Federal Court of Canada, Trial Division, in a decision reported 57 F.T.R. 57, dismissed the application. Martinoff appealed.
The Federal Court of Appeal, allowed the appeal.

Weapons - Licensing - Pursuant to a policy against Canada-wide permits, the Commissioner of the R.C.M.P. refused to issue a Canada-wide permit under s. 110(5) of the Criminal Code to a retailer of firearms - The retailer submitted that a permit must be issued if safety concerns were met - The trial judge refused to order the Commissioner to issue a permit, holding he did not exceed or fail to exercise jurisdiction, where safety was not the only factor to be considered and a policy of close local control of retail firearms businesses was relevant - The Federal Court of Appeal issued mandamus requiring the Commissioner to consider the application on its merits.
