Résumé:

The New Brunswick Court of Appeal reversed in part judgment of trial court dismissing Plaintiff's action.

The New Brunswick Court of Appeal held that Plaintiff and Defendant were equally at fault for damages arising out of a motor vehicle accident occurring on the Trans Canada Highway arising out of an attempt by the Defendant/Respondent to cross the Trans Canada Highway.

The New Brunswick Court of Appeal held that Defendant/Respondent Lizotte, should have seen the approaching motor vehicle of the Plaintiff/ Appellant to his left, and should have yielded right-of-way to the Plaintiff/Appellant.

The New Brunswick Court of Appeal held that failure to see what is clearly visible constitutes negligence.

The New Brunswick Court of Appeal held that the Plaintiff/Appellant was negligent in failing to decrease speed on passing a road sign just prior to the collision which indicated that an intersection or crossroad was ahead.
