Summary:

A case management action was placed on the "fast track". The defendant was noted in default. The defendant applied to set aside the noting in default.

The Ontario Court (General Division) dismissed the motion. The defendant repeatedly and persistently disregarded the Rules of Civil Procedure. Delaying the trial could result in the financial ruin of the plaintiff. The fact that it was a fast track case management action was an aggravating factor.
