As damages - Prejudgment interest - Entitlement - A husband owned the matrimonial home - He was granted interim possession - The wife unsuccessfully claimed an equal interest by constructive trust - The husband had no other asset with which to pay a family property equalization payment and could not have sold or mortgaged the home to pay equalization payments while the wife's claim was outstanding - The trial judge allowed the husband a reasonable time to obtain funds to make the payment and declined to award prejudgment interest - The Ontario Divisional Court affirmed the decision.

As damages - Prejudgment interest - Entitlement - The Ontario Divisional Court stated that the commercial test (placing the plaintiff in the same position, so far as money is concerned, as he would have been in if the loss had not been suffered), did not apply when exercising discretion to award prejudgment interest on family property equalization payments - The court identified circumstances where prejudgment interest was inappropriate, namely, where payment is to be made out of capital which has not been earning interest; where payment relates to an asset that could not have been realized on in the past; or where payment was to be made from an asset that was not liquid - See paragraphs 6 to 9.
