Landlord and Tenant - Topic 8768

Distress - Goods not liable to distress by a landlord - Goods in custodia legis (in the custody of the law) - A tenant granted a chattel mortgage respecting all of the goods on the tenant's premises - The tenant defaulted under the chattel mortgage and the mortgagee issued a distress warrant to seize the mortgaged chattels - The sheriff seized the goods on behalf of the mortgagee but did not remove the goods from the tenant's premises - Subsequently, the landlord issued a distress warrant for arrears of rent and seized the same goods on the tenant's premises - The Alberta District Court held that the landlord's seizure was invalid because when the landlord attempted to seize the goods they were custodia legis (in the custody of the law).
