Accident and sickness insurance - The contract - Interpretation of terms - Injury - An insured's accident insurance policy stated that "'injury' means bodily injury caused by an accident ... which injury results ... directly and independently of all other causes, in ... dismemberment" - The insured injured her big toe - Subsequently, her toe and foot became gangrenous and infected, requiring the amputation of her leg below the knee - She suffered from arteriosclerosis and diabetes, which conditions together resulted in the injured toe becoming gangrenous - The gangrenous condition would likely have occurred even without the injury - The Manitoba Court of Queen's Bench in a judgment reported 3 Man.R.(2d) 49 dismissed the insured's action for the proceeds under the policy and held that the amputation of her leg was not an "injury" within the meaning of the policy, because it did not result "directly and independently of all other causes"; namely, arteriosclerosis and diabetes - The Manitoba Court of Appeal, Monnin, J.A., dissenting, allowed the appeal and held that the amputation of her leg was an injury within the meaning of the policy, because it resulted "directly and independently of all other causes" - The Court of Appeal held that arteriosclerosis and diabetes were merely causa sine qua non, and not the proximate cause or causa causans of the amputation.
