66 Criminal Appeals: A Practitioner’s Handbook
I. Introduction
This chapter deals with preliminary procedures in an appeal in which one of the parties
appeal. Common motions and applications include applications for bail pending appeal;
motions to stay pending appeal ancillary orders imposed during sentencing such as
a party to intervene; applications for leave to appeal (required for sentence appeals and
appeals to the court of appeal from a summary conviction appeal); and motions to

II. Bail Pending Appeal
A. Indictable Appeals
Criminal Code1 sets out the jurisdiction

of appeal may release an appellant from custody pending the determination of his or
