Summary:
This case arose out of an action for damages for personal injuries arising out of an accident. The plaintiff commenced his action against two defendants. Subsequently, the plaintiff purported to add a third defendant by issuing an amended statement of claim which was the wrong procedure. The third defendant applied to the Alberta District Court to set aside the issue of the amended statement of claim. The District Court allowed the application and set aside the issue of the amended statement of claim. The judgment of the Alberta District Court is set out below - see paragraphs 22 to 51.
On appeal to the Alberta Court of Appeal the appeal was allowed and the order of the Alberta District Court was set aside. The Alberta Court of Appeal stated that the plaintiff's mistake in non-compliance with the rules was an irregularity which could be cured under Rule 558.
