Résumé:

A nine year old girl was the subject of an application by the Minister of Social Development for a guardianship order aimed at extinguishing the parental rights of the biological parents. The mother brought a motion asking that an order be issued conditionally staying proceedings until a lawyer was appointed, paid for by the Minister of Justice, to represent her interests at the trial.

The New Brunswick Court of Queen's Bench, Family Division, dismissed the motion.

C.M. (2012 NBCA) - The mother failed to establish that she fell into the category covered by the decision in New Brunswick (Minister of Health and Community Services) v. J.G.and D.V. (1999 SCC), as interpreted in C.M. - Her motion had to be denied on that basis.
