A Queen's Bench judge granted a consolidation order under rule 6.01 of the Rules of Court of an application for guardianship of children and a custody application by grandparents of the children pursuant to the Family Services Act. The Minister of Social Development appealed.

The New Brunswick Court of Appeal allowed the appeal.

Joinder of causes and consolidations - Consolidation of actions and applications or motions - When not available - A Queen's Bench judge granted a consolidation order under rule 6.01(d) of the Rules of Court of a guardianship application of children and a custody application by grandparents under the Family Services Act - The Minister of Social Development appealed - The New Brunswick Court of Appeal allowed the appeal - The Act did not provide for competing litigation between natural parents and other interested persons - If the two applications were consolidated, the respondent biological parents might be at risk of having their s. 7 Charter rights violated because the onus would shift to them to prove they had better parenting skills than another interested party, rather than the onus being on the Minister to prove that granting a guardianship would be in the "best interests of the children" - The Minister could not be placed in the untenable position of being a respondent opposing a custody application by the respondent grandmother while seeking a guardianship order against the respondent parents - Practical issues of disclosure might also arise - While consolidation was not available, other possible relief was - The preferable ones would be to hear the guardianship application first and the custody one immediately after or to stay the custody application until the guardianship application was determined pursuant to rule 6.01(1)(d) or (e)(i).
