NEGLIGENCE
This huge portion of tort law deals with acts (or omissions) that cause harm to others. Nor-
mally, for negligence to be proved a plaintiff must show that the defendant had some respon-
sibility to take care not to harm the plaintiff (duty of care), that what the defendant did (or
failed to do) which caused the harm was not what a reasonable person would have done (stan-
dard of care), and, f‌inally, that the plaintiff did, in fact, suffer some injury from the defendant’s
action. Some negligent acts, however, can be proved without reference to the above test. This
type of negligence is referred to as absolute or strict liability. There are also certain negligent
acts that constitute a crime (i.e., criminal negligence). This is an area of the law that is rooted
primarily in jurisprudence. All major works on torts also contain chapters devoted to negli-
