Summary:

The plaintiff brought an action against the defendants for damages for trespass and conversion of the plaintiff's property. The plaintiff gave the defendant permission to set up a camp site on its property and to use one of its boats. The defendant was not permitted to use any of the buildings or the facilities on the property. The plaintiff used the facilities and buildings and damaged three of the plaintiff's boats and their motors. The Northwest Territories Supreme Court allowed the action against the defendant Gillum and dismissed the action against the defendant Royal Aviation Inc., because the latter defendant was defunct and therefore, unable to meet the obligations of the judgment. The court held that the defendant committed trespass and conversion in respect of the plaintiff's property. The court awarded the plaintiff $31,200 general damages and $12,000.00 exemplary damages.
