NUISANCE
A specif‌ic subset of tort law, Nuisance is an act (or omission) by one party that affects another
party’s ability to use and enjoy their property, or negatively affects their comfort or health.
There are two major divisions within this topic: private nuisance (where the affected party is
an individual or specif‌ic individuals) and public nuisance (where the public is affected gener-
ally). Examples of nuisance include noise, smells, smoke, etc. There is also criminal nuisance
(which is always a public nuisance) by virtue of section 180 of the Criminal Code. There are
numerous municipal by-laws that deal with nuisance (e.g., anti-noise ordinances), and most
provinces have a statute dealing with nuisance and a number have other enactments enabling
certain agricultural operations to engage in activities that might otherwise be considered to be
