Summary:
The Superintendent of Pensions for Ontario refused to approve a windup report for a pension plan established by an employer for the benefit of unionized employees. The Pension Commission of Ontario affirmed the refusal. The employer appealed.
The Ontario Divisional Court allowed the appeal and returned the matter to the commission.

Remuneration - Pension benefits - Termination of plan - An employer ceased contributions to a pension plan and transferred sufficient assets to a new plan to fund prior service of employees who had transferred from the old plan - The Pension Commission refused to approve a windup report where the second plan was a successor to the first within the meaning of s. 81(1) of the Ontario Benefits Act which prohibited winding up - The Ontario Divisional Court held that s. 81(1) did not apply, and the first plan, although wound up, was deemed not to be wound up.
