Résumé:
In an action for damages for personal injuries arising out of a tobogganing accident, the defendant/owner, The Saint John Horticultural Association, was held not liable because it had no knowledge of the dangerous condition of the premises. The persons using the toboggan slide were found to be licensees.
The New Brunswick Court of Appeal held that the defendant, The City of Saint John, was not liable because it was not an "occupier" of the premises at the time of the accident as it was not the owner of the premises nor did it regulate the use of the tobogganing slide. However, the New Brunswick Court of Appeal held the defendant, The City of Saint John, liable because it altered the level of the ground around the toboggan slide which resulted in the dangerous condition which caused the plaintiff's injuries.
