Summary:
The defendant applied for a stay of the action on the ground that further proceedings in it should take place in England, based on a charter party arbitration provision.
The British Columbia Supreme Court dismissed the application. The defendant appealed.
The British Columbia Court of Appeal allowed the appeal.

Stay of proceedings - Arbitration clause - Enforcement of - Charter agreements respecting two ships provided for arbitration in London, England - The charterer defaulted - The owners obtained final arbitration awards and sought to enforce them without success - The owners developed a theory that if any entity bearing the name of the charterer existed at all, that entity was a worthless shell that had been used by the defendant to obtain the benefit of the charter without paying for it - The owners sued the defendant in British Columbia - The defendant applied for a stay of the action, arguing that further proceedings should take place in England, based on the arbitration provisions in the charter agreements - The British Columbia Court of Appeal held that the plaintiffs' allegations fell squarely within the arbitration provisions because the real issue was whether the defendant was the "defaulting charterer" - The court granted a stay.
