Admission - Refugees - Grounds - Well-founded fear of persecution - Indirect persecution - An Iranian applied for Convention refugee status - Her son had fled Iran because his friends had been arrested and there was concern that they had documents that would implicate the son in anti-government activities - The son claimed that the Iranian authorities were looking for him - The mother was questioned but suffered no repercussions - The Immigration and Refugee Board dismissed the mother's application - The mother applied for judicial review on the ground that, inter alia, the Board should have considered the issue of indirect persecution - The Federal Court of Canada, Trial Division, dismissed the application - See paragraphs 7 to 25.

Admission - Refugees - Grounds - Well-founded fear of persecution - Indirect persecution - An Iranian mother claimed Convention refugee status on the basis of "indirect persecution" in that her son was being pursued by the Iranian government - The Federal Court of Canada, Trial Division, per Rothstein, J., stated that "indirect persecution unjustifiably broadens the Convention refugee basis for admission to Canada, to include persons who do not have a well-founded fear of persecution in their own right ... it seems that sections 46.04(1) and (3) [of the Immigration Act] would account for the large majority of persons who might otherwise fit the indirect persecution category as defined in Bhatti" - See paragraphs 10 and 11.
