In most parts of Canada, criminal appeal work has traditionally been concentrated

among a small group of specialists who make it a major focus of their practice. The

   

make appeals a large and sometimes intimidating departure from the regular work of

most criminal lawyers.

This book aims to demystify the conduct of criminal appeals in Canada and provide



The rules and practices of appellate courts vary dramatically from province to

province, and in some cases from one district, region, or county to another. Collecting

all of the rules of court across Canada is beyond the scope of this book. We cover the

Criminal Code rules and procedures applicable in all courts and will refer to some



motions commonly brought in connection with criminal appeals, the rules and pro-

cedures for adducing fresh evidence on appeal, particular issues arising in sentence

appeals, procedures in summary conviction appeals, and leave applications and appeals

in the Supreme Court of Canada.
