Preface

In late 2016, Peter Keen was approached by Sean Doyle and asked if he would be

interested in being a part of Emond Publishing’s amazing new criminal law series. The

subject matter was drinking and driving law.

Peter, living up to his last name, was overjoyed at being asked to write a book. Now

he had to look for a writing partner—preferably someone who would compliment him

on his brilliance. Alas, no such person existed. Having been paired up with Karen

Jokinen at the behest of Irwin Isenstein at the Law Society of Ontario’s drinking and

driving seminars, he decided she would be the perfect yin to his yang.

Her response was, “You want me to write a what?”

After explaining what a book was, and after Karen had stopped laughing, the deal

was done. Thus began a six-year-long debate over the state of the law that shows no

sign of abating. We have argued, fought, criticized each other’s writing, and furiously

edited the other’s work. The end product is far better than what either of us could

have produced alone. In the process, we have had a lot of fun.

After preparing the first edition, we thought that the second edition would be a

breeze. After all, there was no litigation during COVID-19, right?

Wrong. Since we began preparing the second edition, there has been a flurry of new

litigation, and legislative changes were receiving royal assent even as the finishing

touches were being put to this book. Legislation has been upheld, overturned, and

restored on appeal, and the editing team put up with our changes with grace and a

determination to get this book published.
