In most parts of Canada, criminal appeal work has traditionally been concentrated

among a small group of specialists who make it a major focus of their practice. The

focus on written advocacy and the very dierent procedures set by appellate courts

make appeals a large and sometimes intimidating departure from the regular work of

most criminal lawyers.

This book aims to demystify the conduct of criminal appeals in Canada and pro-

vide a guide for lawyers taking on their f‌irst appeal or looking to make appeals a larger

part of their practice.

The rules and practices of appellate courts vary dramatically from province to

province, and in some cases from one district, region, or county to another. Collect-

ing all of the rules of court across Canada is beyond the scope of this book. We cover

the Criminal Code rules and procedures applicable in all courts and will refer to some

important dierences in practice in dierent provinces and territories. We also

address motions commonly brought in connection with criminal appeals, the rules

and procedures for adducing fresh evidence on appeal, particular issues arising in

sentence appeals, procedures in summary conviction appeals, and leave applications

and appeals in the Supreme Court of Canada.

In addition to discussing these procedural issues, we also oer some advice on ef-

fective written and oral advocacy in appellate courts and outline some of the more

common grounds of appeal.
