PRIVACY LAW & ACCESS TO INFORMATION

These two topics, which are frequently grouped together, relate to different ends of the informa-

tion availability spectrum. Privacy law deals with the right of individuals to keep information

about themselves private and, in cases where it must be disclosed to certain parties, the obliga-

tions on second parties to ensure that the information is not disclosed unnecessarily to third par-

ties. Access to information, on the other hand, refers to the rights of citizens and organizations

to see information created and held by the various levels of government in the process of gov-

erning. Both the federal and provincial levels of government are subject to access to information

legislation and most provinces have statutes protecting the privacy rights of its citizens. Related

Ce domaine comporte deux principales dimensions : l’accès à un document détenu par un

organisme et l’accès du citoyen à des informations le concernant, détenues par un organisme

public ou une entreprise privée. La protection de la vie privée est couverte par le Code Civil du

Québec. Le fédéral et le Québec ont tous deux légiféré. Le droit de l’information proprement dit

(radio, télévision, etc.) est traité sous COMMUNICATIONS (DROIT DES).
