Abstract: This article f‌irst considers the courts’ approach to

the proportionality pr inciple since its entry in Quebec pro-

cedural law in the early 2000s. At the time, the introduction

of this governing pr inciple founded the hopes of a change

in judicial culture t hat would in turn pave the way to better

access to justice and more eff‌icient use of judicial resources.

However, thirteen years later, the author obser ves that the

ambitions of the proportionality principle have largely been

stif‌led by the system atic restraint shown by t he judiciary

with respect to its application.

Specif‌ically, the author contends that the proportionality

principle is improperly considered in t he context of class

action authorization. At times invoked as a synonym for the

preferable character of the class-type action, or invoked as a

mere interpretative aid, t he Supreme Court of Canada h as re-

cently endorsed a minimalist approach to proportionality at

the authorization stage. The author condemns this approach

and notes the consequences it has induced; those are espe-

cially troubling w ith respect to the objective of judicial econ-

omy that the class action vehicle pursues. Indeed, judicial

conservatism is what will have impeded the much-needed

change in the prevailing judicial culture of Quebec.

By way of conclusion, the author offers a ref‌lection with

respect to the probable future of t he proportional ity principle

in the context of the new Code of Civil Procedure’s enteri ng

into force, and with respect to t he role which proportionality

ought to play within the framework of the “new civil justice”

that this legislat ion promises to implement.

Une nouvelle ère procédurale aujourd’hui à nos portes, le moment est

propice pour s’adonner à une étude rétrospective de certains lieux com-

muns qui ont façonné notre système de justice civile. Fruits de réformes

passées, certains outils sont devenus de véritables repères du droit

procédural en vigueur au Québec, et ont été précisés au gré des vents

politiques, économiques et sociaux qu’a connus la belle province. L’intro-

duction d’un régime de recours collectifs à l’américaine en 1978 fut une

de ces bourrasques qui changea le paysage procédur al québécois, jusqu’à

faire du Québec le « paradis » de ce recours procédural singulier1. De
