PRODUCTS LIABILITY
This area of law is a particular subset within torts, and, more specif‌ically, is usually regarded
as a particular instance of negligence. Products liability cases most frequently arise when a de-
fective product has in some way caused harm to the plaintiff. This is an area of provincial juris-
diction, but is guided primarily by principles established in the common law, many emanating
from the famous English Court of Appeal decision, Donoghue v. Stevenson of the 1930s. Related
topics: CLASS ACTIONS, NEGLIGENCE, SALE OF GOODS, TORTS.
