Summary:

The divorcing parties asked the court to determine the issue of how much overtime income was to be imputed to the husband and how much child and spousal support he was to pay. At issue also was whether an income tax "paper loss" was to be imputed as income.

The New Brunswick Court of Queen's Bench, Family Division, determined the issues accordingly.

Divorce - Corollary relief - Maintenance - Support guidelines (incl. nondivorce cases) - Calculation or attribution of income - The New Brunswick Court of Queen's Bench, Family Division, discussed the impact of the payor's overtime in respect of the imputation of income under the Federal Child Support guidelines - In the present case, the court ruled that previous working of overtime, its availability and the fact that the payor husband had the health to withstand it, did not, in and of itself mandate the court to require that it be worked - The issue was whether the husband was working to his full earning capacity - Full earning capacity should be determined to be a capacity that was rea­sonable in all circumstances - The court provided a non exhaustive list of consider­ations for analysis (see paragraph 44) - The court imputed 110 hours of overtime to the husband's 2005 income after noting a peak of 998 hours in 2000 a low of 110 hours in 2004, the availability of 110 to 267 hours in 2005 and the husband's life choices - See paragraphs 18 to 85.

Divorce - Corollary relief - Maintenance - Support guidelines (incl. nondivorce cases) - Calculation or attribution of income - The payor husband included in his finan­cial statement his monthly mortgage pay­ment, property tax payment, property insurance payment, electric and heat pay­ment, and renovation and maintenance costs - However, there was no mention of any contribution to these expenses from income the husband received from an apartment he rented - Revenue Canada allowed the husband to claim a loss in respect of the apartment - The New Bruns­wick Court of Queen's Bench, Family Division, imputed to the payor husband's income the loss allowed by Revenue Can­ada - See paragraphs 113 to 118.
