Résumé:

This case arose out of a charge of influence peddling contrary to s. 110(1)(d) of the Criminal Code. The accused elected trial by judge and jury and after a preliminary inquiry the accused was committed for trial. The accused applied to the New Brunswick Court of Appeal for an order of certiorari to remove and quash the order for committal for trial.

The New Brunswick Court of Appeal dismissed the accused's application.

The accused applied for and was granted leave to appeal to the Supreme Court of Canada on December 18, 1979 - see Bulletin of Proceedings taken in the Supreme Court of Canada dated December 21, 1979 at pages 10 and 32.

Offences against the administration of law and justice - Influence peddling - "Person" defined for purposes of s. 110(1)(d) of the Criminal Code - The accused was charged with pretending to have influence with the Government of the Province of New Brunswick and with accepting rewards (on behalf of the Progressive Conservative Party) for the exercise of such influence - Whether the Progressive Conservative Party was a "person" for purposes of s. 110(1)(d) of the Criminal Code - The New Brunswick Provincial Court, after a preliminary inquiry, held that the Progressive Conservative Party was a "person" for purposes of s. 110(1)(d) and committed the accused to trial.
