Summary:

The accused was charged with unlawful confinement, assault and sexual assault. The Crown indicated that if the accused was found guilty of sexual assault, the charge of assault should be dismissed.

The Saskatchewan Court of Queen's Bench, in a decision reported at 330 Sask.R. 27, found the accused guilty of sexual assault and not guilty of unlawful confinement. The court dismissed the charge of assault. The Crown applied to have the accused declared to be a dangerous offender and for the imposition of an indeterminate sentence.

The Saskatchewan Court of Queen's Bench, in a decision reported at 344 Sask.R. 206, granted the application. The court also imposed a lifetime firearms prohibition order and a DNA order and directed that the accused comply with the Sex Offender Information Registration Act for 20 years. The accused appealed the conviction and sentence.

The Saskatchewan Court of Appeal, in a decision reported at 405 Sask.R. 97; 563 W.A.C. 97, dismissed the conviction appeal, allowed the sentence appeal and remitted the matter to the trial judge to impose a suitable long-term offender sentence.

The Saskatchewan Court of Queen's Bench sentenced the accused to eight years' imprisonment, reduced by six years for time spent in remand or penitentiary custody, to be followed by seven years of long-term supervision in the community.

Sentencing - Considerations - Aboriginal offenders - The accused, a 48 year old aboriginal male, was convicted of sexually assaulting an acquaintance and was declared to be a long-term offender - The assault was a repeated occurrence of non-consensual intercourse over a number of hours accompanied by physical violence - The impact on the victim was dramatic - The accused's adult record commenced at age 16 and consisted of some 95 offences, including 15 violent and violence-related offences - While incarcerated, he followed a corrections plan and completed a moderate intensity substance abuse program - He had yet to take the moderate and intensive sex offender treatment programs - The Saskatchewan Court of Queen's Bench, having regard to the primary consideration of the accused's treatment needs and the eventual control of his risk of re-offending, concluded that further incarceration was necessary - The court imposed eight years' imprisonment, reduced by six years for five years and 11 months spent in remand or penitentiary custody - The court also imposed seven years of supervision in the community at which time the accused would be 55 years of age - That period of time, combined with his reduced risk consequent upon the additional programming and with his age and maturity, should be effective to reduce his risk of re-offending - See paragraph 60 to 71.
