Federal jurisdiction - Fisheries, s. 91(12) of the Constitution Act, 1982 - The New Brunswick Provincial Court referred to the scope of the federal power in relation to fisheries (see paragraphs 7 to 9) - The court declared valid s. 31(1) of the federal Fisheries Act which prohibited harmful alteration, disruption or destruction of fish habitat (see paragraph 10).
