Summary:

The accused was charged with driving with an excessive blood-alcohol level and with impaired driving.

The Nova Scotia Provincial Court acquitted the accused of the first offence but convicted him of the second offence.

Motor vehicles - Impaired driving - Breathalyzer or blood sample - Demand - Reasonable grounds - The police responded to an accident - A police officer observed indicia of impairment by the accused and made a demand for a breath sample - The accused agreed to comply - Soon after, the accused, began to complain of chest pains - He also had a cut on his head - The officer made a demand for a blood sample given that the accused was being taken to the hospital by ambulance - The Nova Scotia Provincial Court held that the officer did not have reasonable and probable grounds to make the demand for a blood sample - He did not have reasonable and probable grounds to believe that the accused's physical condition rendered him incapable of providing a breath sample or that it would be impracticable to obtain a breath sample - See paragraphs 32 to 40.

Motor vehicles - Impaired driving - Breathalyzer or blood sample - Evidence and certificate evidence - An accused argued that the container used to house his blood samples was not an approved container - The container label was marked Vacutainer XF 947 with the trademark designation "TM" - The definition of an approved container referred to Vacutainer XF 947 but the trademark designation was depicted with a R with a circle around it - The Nova Scotia Provincial Court held that a Vacutainer XF 947 was the prescribed vessel according to the definition - The presence or absence of any trademark notation or the presence of a different trademark notation did not affect the validity of the use of that particular vessel - See paragraphs 17 to 22.
