The accused was charged with having care and control of a vehicle while he had an excessive blood-alcohol content.

Motor vehicles - Impaired driving - Care or control, what constitutes - The accused, who had been drinking, sat in the driver's seat of his car to wait for a cab - He did not put the key in the ignition - The Saskatchewan Provincial Court found the accused not guilty of having care and control of a motor vehicle while having an excessive blood-alcohol content - The accused established that he did not occupy the driver's seat for the purpose of setting the vehicle in motion and there was a reasonable doubt about whether the Crown established that the accused had intent to do anything with the vehicle that would create a danger.
