Criminal Law - Topic 5847
Sentencing - Considerations on imposing sentence - Remorse of accused - In sentencing the accused to 54 months in jail for sexual assault on a minor, the trial judge said that there were little or no mitigating factors in this case and that the accused expressed no remorse towards the complainant - The accused sought leave to appeal against the sentence, arguing that the trial judge erred in his approach to remorse - The New Brunswick Court of Appeal denied leave to appeal - The trial judge did not elevate lack of remorse to an "aggravating factor" when he observed that remorse was unavailable as a mitigating factor - See paragraphs 6 and 7.
Criminal Law - Topic 5932
Sentence - Sexual assault (incl. by multiple parties) - The trial judge convicted the accused of sexual assault in respect of incidents perpetrated on his common law spouse's daughter when the daughter was aged between 11 and 16 years - The incidents included fondling, digital penetration of the vagina, masturbation and fellatio, and culminated in what the complainant believed to have been penile penetration of her vagina while she was lying on her bed pretending to be asleep - The trial judge sentenced the accused to 54 months in jail - The accused sought leave to appeal against the sentence - The New Brunswick Court of Appeal denied leave to appeal where the sentence was not "excessive" - See paragraphs 8 to 10.
