Summary:

The accused was convicted of aggravated assault contrary to s. 245.2(1) of the Criminal Code when she engaged in a knife fight with the victim following an altercation between the two in a hotel lobby. The trial judge sentenced the accused to three months imprisonment. The accused appealed on the ground that she did not assault the victim because the victim consented to the fight.

The Alberta Court of Appeal dismissed the appeal and held that consent to the fight was not a defence to a charge of aggravated assault where weapons were involved.
